Cet article s’interroge sur le statut épistémologique des fictions employées en théorie politique, dont l’état de nature constitue l’un des cas exemplaires. Contre les critiques relativistes et celles d’inspiration marxiste , on montre que l’utilisation des fictions obéit à des règles précises du point de vue de leur finalité et de leur justification, ce qui interdit de considérer toutes les fictions comme équivalentes. Cette problématique est illustrée à partir de la théorie des fictions développée par le philosophe néokantien Hans Vaihinger (...) et en la comparant avec l’usage des fictions tel qu’on le trouve illustré dans les écrits scientifiques et politiques de Thomas Hobbes .This article addresses the question of the epistemological status of fictional discourse in political theory, the « state of nature » being one of its paradigmatic examples. Against both relativism and Marxist critiques , it is argued that the use of fiction obeys to well-defined rules from the point of view of their finality and justification, which forbids us to consider all fictions as equivalent. This problem is illustrated by means of a presentation of the theory of fictions developed by the Neo-Kantian philosopher Hans Vaihinger and by comparing it to the use of fictions as found in the scientific and political writings of Thomas Hobbes. Two of his major works, The Age of Constantine the Great (1852) and The Civilization of the Renaissance in Italy (1860), bear out this claim. In his Constantine Burckhardt deals with the transition from late pagan antiquity to the early Christian Middle Ages, and in his more famous Renaissance he deals with the transition from the late Middle Ages to the beginnings of secular modernity. In the [End Page 149] latter, as is well known, he established one of the most compelling and creative theses in the history of modern historiography, virtually creating the “idea of the Renaissance” that has long influenced both scholarly and popular conceptions of that period. 3What elicited Burckhardt’s interest in crises and transitions in general and in these two periods of crisis and transition in particular? In this article, I shall argue that there is a strong relationship between Burckhardt’s own historical experience in the early and mid-nineteenth century and his choice of subject and mode of analysis in these two monumental works. In theoretical terms one observes a “dialectical” form of objectivity in the execution of Burckhardt’s historiographical tasks: a structural affinity or kinship between subject (Burckhardt, his historical experience) and object (late antiquity, Renaissance) predisposes Burckhardt to his theme/argument and thus provides a key to understanding the genesis and the character of insights that he offers in these two works. 4 To establish this point I shall focus on the category of religion, on Burckhardt’s own experience of questions of religious truth and skepticism in the nineteenth century, and on his treatment of religion in these two works.The Young Jacob Burckhardt and ReligionReligion is a crucial but often neglected aspect of Jacob Burckhardt’s thought. 5 Like a number of nineteenth-century German intellectuals, Burckhardt was a Pfarrersohn, a “pastor’s son.” 6 He grew up in a profoundly conservative Protestant environment in Basel, nicknamed “pious Basel” for its dogged resistance to the “ideas of 1789” and for its earlier heritage of Reformation and pietist religiosity. During Burckhardt’s youth in fact, his father was a children’s minister and head-deacon (Obersthelfer) before becoming in 1838 the city cathedral’s Antistes, the highest and most prestigious ecclesiastical office in Basel. In short, as his biographer Werner Kaegi has noted, Burckhardt’s early [End Page 150] upbringing and education were strongly shaped by the world of his father, a world of “old Protestant piety.” 7Following his father’s example, Burckhardt started out on the clerical track, studying theology at the University of Basel. However, during his Theologie-studium (1837–39) he experienced a profound crisis of faith brought on by an encounter with German historical biblical criticism and liberal theology represented in the person of W. M. L. de Wette (1780–1848). A radical theologian and biblical scholar, de Wette had wound up in Basel in 1822 after being dismissed from the University of Berlin for holding views considered heterodox and politically threatening by the conservative Prussian government. 8 In a letter to his friend Johannes Riggenbach written in August 1838 Burckhardt tells how de Wette’s critical theology had unseated his faith. “In my eyes,” Burckhardt wrote,de Wette’s system grows in stature every day; one simply must follow him, there is no alternative; but every day a part of our traditional church doctrine melts away under his hand. This book offers an interpretation of the rise of secular historical thought in nineteenth-century Europe. Instead of characterizing 'historicism' and 'secularization' as fundamental breaks with Europe's religious heritage, they are presented as complex cultural permutations with much continuity; for inherited theological patterns of interpreting experience determined to a large degree the conditions, possibilities, and limitations of the forms of historical imagination realizable by nineteenth-century secular intellectuals. This point is made by examining the thought of the German theologian W. M. L. (...) de Wette and that of the Swiss-German historian Jacob Burckhardt. Burckhardt's meeting with de Wette and his subsequent decision to study history over theology are interpreted as revealing moments in nineteenth-century intellectual history. By examining their encounter, its larger historical context, and the thought of both men, the book demonstrates the centrality of theological concerns and forms of knowledge in the emergence of modern, secular historical consciousness. Der vorliegende Band geht auf zahlreiche Beispiele ein, insbesondere auf die Rezeption Jacob Böhmes in der Romantik. Mysticism and Romanticism are counter-models of an ever stranger modernity. Romanticism as a cultural epoch absorbs the supra-temporal religious phenomenon of mysticism. This volume deals with numerous examples, specifically the reception of Jacob Böhme in Romanticism.

This paper poses the question “Why did Augustine not use his Trinitarian theology to better effect in the Pelagian controversy?” I demonstrate first that Augustine’s mature Trinitarian theology would be directly relevant to the Pelagian discussions after the year 415. Second, I show a slight progression in Augustine’s treatment of relevant issues from 418 through the end of his life in his anti-Pelagian corpus. I argue that Augustine does not use his Trinitarian theology to his full advantage in the anti-Pelagian (...) corpus. I suggest that Augustine avoided these connections at least in parí because the Trinitarian reflections on “God is love” (I Jn 4) would ultimately push the anti-Pelagian reflections on God’s love for Jacob (Rom 9:13) towards universalism, but Augustine had already rejected universalism. The thesis that republicanism was only suited for small states was given its decisive eighteenth-century formulation by Montesquieu, who emphasized not only republics' need for homogeneity and virtue but also the difficulty of constraining military and executive power in large republics. Hume and Publius famously replaced small republics' virtue and homogeneity with large republics' plurality of contending factions. Even those who shared this turn to modern liberty, commerce and the accompanying heterogeneity of interests, however, did not all agree with or (...) know about Publius' institutional responses to the problems of executive and military power. Throughout the late eighteenth and early nineteenth centuries, and on both sides of the Atlantic, it remained a live question whether large states could be stable moderate republics, with responses ranging from embraces of Montesquieuian limited monarchy, to denials that there was any real large-republic problem at all, with a variety of institutional solutions in between for those who thought there was a real but soluble large-republic problem. Gemäß der ersten könnte man wie William Alston oder Richard Swinburne für eine Form der Univozität zwischen der Bedeutung der Ausdrücke plädieren, die von Gott und den Menschen gemeinsam gebraucht werden. Die zweite, hier favorisierte Lösungsstrategie kann über eine metaontologische Unterscheidung zwischen fundamentalen und nicht-fundamentalen Wahrheiten (...) konsistent darlegen, wie man mit wörtlich verstandener Sprache wahre Aussagen über das Wesen Gottes machen kann, ohne dabei die Einfachheit Gottes preisgeben zu müssen. Post-Structuralist Discourse Theory analyzes political ideas and action from a Marxist direction. However, while classic Marxian sociology is rooted in economic processes that “structure” society and ideas, Post-Structuralist Discourse Theory emphasizes the absence of any determinative principle. Thus, it radicalizes an ongoing shift in Marxism away from economic essentialism towards indeterminacy, contingency, and openness. The ideological superstructure becomes ever more important at the expense of the economic base; class struggle and relations of production lose analytical and strategic purchase in favor (...) of a complex and integral form of politics; there are no deeper, natural foundations determining how society is organized and structured. Post-Structuralist Discourse Theorists argue that this orientation leads to a more satisfactory analysis of political practice than is possible through positivist research. Assessing this claim requires a survey of the hermetic terminology in which Post-Structuralist Discourse Theorists express their ideas—the discourse, as it were, of Discourse Theorists—exploring their use of sociology, structuralist linguistics, psychoanalysis, and the political theory of populism. Poststructuralist discourse theory is enjoying increasing recognition for its potential to contribute to the study of institutional change and continuity. Yet the most fruitful approach to realizing this potential has hitherto not been found. The main proposition so far has been to operationalize DT’s insights and concepts by adopting them into the framework of discursive institutionalism. However, an ongoing debate about the compatibility of the ontologies underlying DT and DI has cast doubts over whether such a combination is theoretically feasible. (...) The critical literature review in the first part of this article indeed finds insurmountable ontological differences between the discourse-theoretical and the discursive-institutionalist traditions, as their clashing notions of what is understood as a ‘discourse’ result in diverging views on power, agency, and subjectivity. Instead of merging DT into DI, I suggest to empower the former as a self-sufficient paradigm for institutional analysis. To achieve this, the second part of this article re-articulates the ‘logics framework’ proposed by Jason Glynos and David Howarth into a middle-range theory for the study of institutionalization and politicization in a discourse-theoretical fashion. The purpose of this re-articulation is to dispel various arguments against the viability of an autonomous poststructuralist approach to institutions. (shrink)

ABSTRACT Ever since an intense theoretical debate over a decade ago, the concept of heterogeneity has had a well-established place within poststructuralist Discourse Theory. It captures the interactions between the heart of the space of representation and its margins, between excluded excess and manifest presence; and conceptualizes particularities, differential remainders, and discursive exteriority. The analytical implications of heterogeneity remain underexploited, however. This contribution makes the case that one way to operationalize the notion of heterogeneity in empirical research is by tracing (...) its strategic effects. Since heterogeneity constitutes ‘the primary terrain within which homogeneizing logics operate’, heterogeneous dynamics like the ‘incorporation of new demands’ and ‘the exclusion of others who were previously present’ affect and shape the availability and feasibility of political strategies. This contribution first provides an extensive definition of heterogeneity drawing on the original debate that gave the concept prominence. An approach that captures and explains the strategic effects of heterogeneity is then developed through the integration of heterogeneity into the logics framework. Finally, this approach is illustrated through an exploration of the politics of international trade. (shrink)

One of Leibniz’s more unusual philosophical projects is his presentation (in a series of unpublished drafts) of an argument for the conclusion that a time will necessarily come when “nothing would happen that had not happened before." Leibniz’s presentations of the argument for such a cyclical cosmology are all too brief, and his discussion of its implications is obscure. Moreover, the conclusion itself seems to be at odds with the main thrust of Leibniz’s own metaphysics. Despite this, we can discern (...) a serious and important point to Leibniz’s consideration of the doctrine, namely in what it suggests about the proper boundary between metaphysics and theology, on the one hand, and ordinary history (whether human or natural), on the other. And we can get a better sense of Leibniz purpose in the essays by considering them in the context of Leibniz's response to Thomas Burnet's "Telluris theoria sacra" (1681-89). Leibniz praises Burnet's history of earth for presenting a harmony between the principles of nature and grace, a harmony absent in the cosmogonies of Descartes and the Newtonians. But Leibniz also complains that Burnet misconceives the boundary between natural explanation and reflections on divine wisdom. And Leibniz's essays on cyclical cosmology suggest the alternative to Burnet's account: a natural history of the earth and its inhabitants should be radically autonomous from, even if ultimately harmonious with, theological principles. The Spirit of the Laws is, without question, one of the central texts in the history of eighteenth-century thought, yet there has been no complete, scholarly English-language edition since that of Thomas Nugent, published in 1750. This lucid translation renders Montesquieu's problematic text newly accessible to a fresh generation of students, helping them to understand quite why Montesquieu was such an important figure in the early enlightenment and why The Spirit of the Laws was, for example, such an influence (...) upon those who framed the American constitution. Fully annotated, this edition focuses attention upon Montesquieu's use of sources and his text as a whole, rather than upon those opening passages towards which critical energies have traditionally been devoted, and a select bibliography and chronology are provided for those coming to Montesquieu's work for the first time. A prevalent assumption in metaethics is that people believe in moral objectivity. If this assumption were true then people should believe in the possibility of objective moral progress, objective moral knowledge, and objective moral error. We developed surveys to investigate whether these predictions hold. Our results suggest that, neither abstractly nor concretely, people dominantly believe in the possibility of objective moral progress, knowledge and error. They attribute less objectivity to these phenomena than in the case of science and no more, (...) or only slightly more, than in the cases of social conventions and personal preferences. This finding was obtained for a regular sample as well as for a sample of people who are particularly likely to be reflective and informed (philosophers and philosophy students). Our paper hence contributes to recent empirical challenges to the thesis that people believe in moral objectivity. (shrink)

Recent proposals for human-centered AI (HCAI) help avoid the challenging task of specifying an objective for AI systems, since HCAI is designed to learn the objectives of the humans it is trying to assist. We think the move to HCAI is an important innovation but are concerned with how an instrumental, economic model of human rational agency has dominated research into HCAI. This paper brings the philosophical debate about human rational agency into the HCAI context, showing how more substantive ways (...) to understand human objectives may improve HCAI. We contrast the economic approach with two more substantive modern alternatives: the realist and constructivist approaches to human rational agency. The realist approach holds that rational agents pursue what is good, while the constructivist approach holds that rational agents make autonomous choices. We illustrate each by considering its implications for fine-tuning large language models for chatbots such as ChatGPT. (shrink)

The purpose of this paper is to engage with the readers in a theoretical reflection on nursing practices in forensic psychiatric settings. In this paper, we argue that practices of exclusion in forensic psychiatric settings share some common ground with Agamben's description of sovereign power and, consequently, the possible creation of zones of exception in this environment. The concept of exception is, therefore, purposely used to shift our thinking, highlight the political forces surrounding exclusionary practices in forensic psychiatric nursing, and (...) explore the ethical tensions that arise for nurses who become entangled in the control of these zones of exception. We argue that ethical and political discussions regarding this phenomenon are necessary if we wish to further understand the complexities of this field of practice and promote constructive change. Pictures in historical chapters of textbooks convey information about the values and assumptions of the authors’professions and the larger culture. We scrutinized 15 recent abnormal psychology textbooks for reproductions of art created before 1900. Thirteen works appeared in three or more textbooks. Overall, these pictures support a “Whiggish” account of history that celebrates the present and gives a distorted, incomplete rendering of the past. The 13 pictures tended to depict the mentally ill as an underclass who are released from their (...) literal and metaphorical shackles by men who are “ahead of their time” in their struggles against prevailing ignorance. The pictures also emphasized the difference of the mentally ill by presenting a catalogue of stereotypic visual elements attributed to insanity throughout Western history. We argue for the inclusion in textbooks of “history for the sake of the past” as a way of genuinely engaging different ideologies and thereby stimulating interest in our own implicit values and biases. It is argued that current neuroimaging studies can provide useful constraints for the construction of models of cognition, and that these studies should be guided by cognitive models. A numberof challenges for a successful cross-fertilization between “mind mappers” and cognitive modelers are discussed in the light of current research on word recognition.

Thomas S. Kuhn acuno la expresion tension esencial para aludir al conflicto entre las tendencias conservadora y revolucionaria en la ciencia. Estas dan lugar respectivamente a la ciencia normal, que trata de salvar al paradigma dominante de las refutaciones, y a la extraordinaria, que responde a las dificultades sustituyendo las viejas teorias por otras radicalmente novedosas. La actitud adoptada en cada momento no esta dictada por normas de racionalidad, sino por la psicologia y la sociologia de los cientificos y (...) sus comunidades. Al conceder una funcion central a la psicosociologia en la explicacion del desarrollo cientifico, Kuhn creo la alta tension hoy omnipresente entre racionalidad e irracionalidad, objetividad y subjetividad, universalismo y relativismo, realismo e idealismo. Este homenaje a la obra de Kuhn recoge diversas contribuciones a las principales caras de esta tension, desde la perspectiva de la filosofia, la sociologia, la psicologia y la historia de la ciencia. Before the passage of the US Immigration Act of 1924, governments of migrant-receiving countries decided whether to admit most prospective immigrants only after they arrived at the border; afterward, the United States and then later other migrant-receiving states required prospective migrants and visitors to apply for visas in their country of residence before coming—an institution that Zolberg has termed “remote control.” Previous scholars wrote about remote control in terms of how it increased the capacity of states to reduce immigration, protect (...) their societies from external threats, and maintain sovereignty, but did not analyze in detail how it did so. Here I analyze three ways through which remote control was a model for a more general revolution in migration control that simultaneously reduced interactions between inhabitants in migrant-receiving societies and those in migrant-sending societies, slowed down the historical reduction of inequality between migrant-sending and migrant-receiving societies, and reduced research and critical awareness within migrant-receiving societies about remote control’s structural impact on societies in general. First, this institution brought more order and precision to the process of individually evaluating prospective visitors. Second, it enabled states to select and define authorized migrants according to their migratory purpose and to force other migrants either to demonstrate enough stamina and strength to enter unauthorized or to die trying. Third, by moving the migrant selection process to migrant-sending societies remote control reduced contact between residents in migrant-receiving societies and prospective migrants in migrant-sending societies. In these three ways, remote control has more generally constrained migratory opportunities and global mobility of individuals between distinct societies. (shrink)
